SafeStride — Walk Safety & SOS

1. Agreement to Terms

By downloading, installing, or using SafeStride (“the App”), you agree to be bound by these Terms of Service (“Terms”). The App is operated by Elevated Systems LLC (“we,” “our,” or “us”). If you do not agree to these Terms, do not use the App.

2. Description of Service

SafeStride is a walking safety application that provides:

  • Walk tracking with GPS, step count, distance, and health metrics
  • Real-time trip sharing with friends
  • Emergency SOS alerts to designated contacts
  • Walk scheduling and coordination
  • Friend connections and activity feeds
  • Lock screen Live Activity during walks
  • Apple Watch companion app

3. Eligibility

You must be at least 13 years old to use SafeStride. If you are under 18, you must have parental or guardian consent. By using the App, you represent that you meet these requirements.

4. Account Registration

  • You must provide accurate and complete information when creating an account
  • You are responsible for maintaining the confidentiality of your account credentials
  • You are responsible for all activity that occurs under your account
  • You must notify us immediately of any unauthorized use of your account
  • We reserve the right to suspend or terminate accounts that violate these Terms

5. Subscriptions & Payments

In-App Purchases

SafeStride may offer premium features through in-app purchases or subscriptions. By making a purchase, you agree to the following:

  • All purchases are processed through Apple's App Store
  • Prices are displayed in your local currency and may vary by region
  • Subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing period
  • You can manage and cancel subscriptions in your Apple ID account settings

No Refunds

All purchases are final and non-refundable.

Once a purchase or subscription payment has been processed, no refunds will be issued. This includes, but is not limited to, subscription fees, one-time purchases, and any premium feature unlocks. If you believe a charge was made in error, you may contact Apple Support to request a review under Apple's refund policy.

6. Acceptable Use

You agree NOT to:

  • Use the App for any illegal or unauthorized purpose
  • Abuse the SOS feature by sending false emergency alerts
  • Harass, stalk, or intimidate other users through the App
  • Share another person's location without their consent
  • Attempt to reverse-engineer, decompile, or disassemble the App
  • Interfere with or disrupt the App's servers or infrastructure
  • Create multiple accounts for fraudulent purposes
  • Use the App in any way that could harm minors

Violation of these rules may result in immediate account termination.

7. Safety Disclaimer

Important Safety Information

SafeStride is designed to enhance personal safety while walking but is NOT a substitute for emergency services. Please understand:

  • SafeStride does not contact 911 or emergency services. The SOS feature sends text messages to your designated emergency contacts only.
  • In a life-threatening emergency, always call 911 (or your local emergency number) first.
  • GPS accuracy depends on your device, environment, and cellular/Wi-Fi connectivity. Location data may not always be precise.
  • The App requires an active internet connection to share location and send alerts.
  • We do not guarantee that SOS messages will be delivered or received in real time.
  • Walk safety scores and route suggestions are informational only and do not guarantee safety.

8. Health Data Disclaimer

Health metrics displayed in SafeStride (heart rate, calories, steps, HRV) are estimates and should not be used for medical diagnosis or treatment. The App is not a medical device. Consult a healthcare professional for medical advice. We are not responsible for any health decisions made based on data shown in the App.

9. Intellectual Property

All content, features, and functionality of SafeStride — including but not limited to the design, text, graphics, logos, icons, software, and code — are the exclusive property of Elevated Systems LLC and are protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works without our written permission.

10. User Content

You retain ownership of any content you create within the App (walk data, profile information). By using the App, you grant us a limited license to use, store, and process your content solely to provide and improve the service. We will not use your content for advertising or share it with third parties except as described in our Privacy Policy.

11. Third-Party Services

SafeStride relies on third-party services including:

  • Apple HealthKit, MapKit, and ActivityKit
  • Google Firebase and Google Places API
  • Apple App Store for payments and subscriptions

We are not responsible for the availability, accuracy, or reliability of these third-party services. Their use is subject to their respective terms and policies.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ELEVATED SYSTEMS LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR PERSONAL INJURY, ARISING OUT OF OR RELATED TO YOUR USE OF SAFESTRIDE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE APP IN THE 12 MONTHS PRECEDING THE CLAIM. SAFESTRIDE IS PROVIDED FOR PERSONAL SAFETY CONVENIENCE AND IS NOT A GUARANTEED SAFETY SYSTEM.

13. Indemnification

You agree to indemnify and hold harmless Elevated Systems LLC, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorney's fees) arising out of your use of the App, violation of these Terms, or infringement of any third-party rights.

14. Disclaimer of Warranties

SAFESTRIDE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT LOCATION DATA WILL BE ACCURATE.

15. Account Termination

  • You may delete your account at any time by contacting us
  • We may suspend or terminate your account for violation of these Terms
  • Upon termination, your right to use the App ceases immediately
  • Sections regarding liability, indemnification, and intellectual property survive termination

16. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of South Carolina, United States, without regard to conflict of law principles. Any disputes shall be resolved in the state or federal courts located in South Carolina.

17. Changes to Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated through the App or via email. Continued use of the App after changes take effect constitutes acceptance of the updated Terms.

18. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

19. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Elevated Systems LLC regarding your use of SafeStride and supersede all prior agreements.
