ForkCast Terms of Use (EULA)

1. Agreement to Terms

By downloading, installing, or using ForkCast ("the App"), you agree to be bound by these Terms of Use ("Terms"). ForkCast is developed and operated by Elevated Systems LLC ("we," "our," or "us"). If you do not agree to these Terms, do not use the App.

2. Description of Service

ForkCast is an AI-powered meal planning application that provides personalized meal plans, recipe suggestions, grocery lists, nutritional tracking, and budget management tools. The App uses artificial intelligence to generate content and recommendations based on your preferences and dietary needs.

3. Eligibility

You must be at least 13 years old to use ForkCast. If you are under 18, you must have the consent of a parent or legal guardian. By using the App, you represent and warrant that you meet these age requirements.

4. Account & Sign In

ForkCast uses Sign in with Apple for account creation and authentication. You are responsible for:

  • Maintaining the security of your Apple ID and device
  • All activity that occurs under your account
  • Notifying us of any unauthorized access to your account

5. Subscriptions & Payments

Auto-Renewable Subscriptions

ForkCast offers the following auto-renewable subscription plans:

  • ForkCast Premium (Individual): $4.99/month — Full access to all premium features for one user
  • ForkCast Premium (Family): $7.99/month — Full access to all premium features with family sharing

Free Trial

Each subscription plan includes a 3-day free trial. You will not be charged during the free trial period. If you do not cancel before the free trial ends, your subscription will automatically begin and you will be charged the subscription price.

Billing

  • Payment is charged to your Apple ID account at confirmation of purchase
  • Your subscription automatically renews each month unless canceled at least 24 hours before the end of the current billing period
  • Your account will be charged for renewal within 24 hours prior to the end of the current period at the same price
  • You can manage and cancel your subscription in your Apple ID Account Settings at any time

Cancellation & No Refunds

You may cancel your subscription at any time through your Apple ID subscription settings. Upon cancellation, you will retain access to premium features until the end of your current billing period. All purchases are final and non-refundable. No refunds or credits will be provided for any partial subscription periods, unused features, or any other reason.

Price Changes

We may change subscription prices at any time. If a price increase takes effect, you will be notified in advance and given the option to accept the new price or cancel your subscription.

6. AI-Generated Content

ForkCast uses artificial intelligence to generate meal plans, recipes, and nutritional suggestions. You acknowledge and agree that:

  • AI-generated content is for informational purposes only and should not be considered professional medical or dietary advice
  • Nutritional information and calorie counts are estimates and may not be completely accurate
  • You should consult a healthcare provider before making significant dietary changes, especially if you have medical conditions or food allergies
  • We do not guarantee the accuracy, completeness, or suitability of AI-generated recipes or meal plans

7. User Conduct

You agree not to:

  • Use the App for any unlawful purpose
  • Attempt to reverse engineer, decompile, or disassemble the App
  • Interfere with or disrupt the App's functionality or servers
  • Use automated systems or bots to access the App
  • Resell, redistribute, or sublicense the App or its content

8. Intellectual Property

All content, features, and functionality of ForkCast, including but not limited to the app design, code, graphics, logos, and AI models, are the exclusive property of Elevated Systems LLC and are protected by copyright, trademark, and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes.

9. Your Data

Your use of the App is also governed by our Privacy Policy, which describes how we collect, use, and protect your information. Meal plans, recipes, and other content you create within the App remain yours. You retain ownership of all data you input into the App.

10. Disclaimers

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

ForkCast is a meal planning tool and does not provide medical, dietary, or nutritional advice. Always consult with a qualified healthcare provider regarding dietary decisions, especially if you have allergies, medical conditions, or specific nutritional needs.

11. Limitation of Liability

IN NO EVENT SHALL ELEVATED SYSTEMS LLC BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR USE OF THE APP. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT PAID BY YOU FOR THE APP IN THE THREE MONTHS PRECEDING THE CLAIM.

12. Indemnification

You agree to indemnify and hold harmless Elevated Systems LLC, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including attorney's fees) arising out of your use of the App or violation of these Terms.

13. Termination

We reserve the right to suspend or terminate your access to ForkCast at any time, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties. Upon termination, your right to use the App will immediately cease. You may also delete your account at any time through the App's settings or by contacting us.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of South Carolina, United States, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be resolved in the courts of South Carolina.

15. Changes to Terms

We may update these Terms from time to time. When we make changes, we will update the "Last Updated" date at the top of this page. Your continued use of ForkCast after any changes constitutes your acceptance of the updated Terms.
